This Privacy Notice (“Privacy Notice”) outlines how Navimow Inc., and our affiliated companies (“Navimow”, “we”, “our” or “us”), use Personal Information (defined below) that we process in connection with your use of our Navimow website at ca.navimow.com (the “Site”), our mobile application (“APP”) and all software, robots, services, products, extensions, subdomains, and application programming interfaces of Navimow or anywhere else we display this Privacy Notice (collectively, our “Services”). We make our Services available to eligible users who have successfully completed the registration process required to use the APP (each a “User”) and to  other visitors of the publicly available portion of the Services (together with Users, “you”, or “your”). Please read this Privacy Notice carefully to better understand how we collect, use, and disclose Personal Information about you as you use our Services.

 

1. Introduction

This Privacy Notice explains what information we or our service providers collect through the Services, how we use or share your information, and your rights with regard to such information.  As used in this Privacy Notice, “Personal Information” means any information relating to an identified or identifiable person or which identifies or can be used to identify an individual. You may choose whether or not to provide or disclose Personal Information in connection with your use of our Services. If you choose not to provide any Personal Information we request, you may still visit and use parts of our Services, but may be unable to access or use certain features, options, programs, products, and services.

2. Notices to Specific Users

 (1) Notices to Canadian Residents

If you reside in Canada, we collect, use, and disclose personal information in accordance with applicable Canadian private laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA)  and, where applicable, substantially similar provincial privacy legislation.

Depending on your province or territory of residence, you may have the right to:

Access your personal information;

Request correction of inaccurate or incomplete personal information;

Withdraw consent, subject to legal or contractual restrictions; and

File a complaint with the applicable privacy regulator.

(2) Notices to Canadian Residents in the Quebec

If you reside in Quebec, your personal information is governed by Quebecs Act Respecting the Protection of Personal Information in the Private Sector, as amended.

In addition to the rights described above, subject to the applicable provincial law, you may also have the right to:

Request information about the use of automated decision-making, where applicable;

Request information regarding the people who have access to their personal information;

Request deletion of personal information in certain circumstances, as permitted by law; and

File a complaint with the Commission d’accès à l’information du Québec.

(3) Minors

Our Service is not intended to use by individuals who are minors (under the age of 18, depending on the law of the jurisdiction you reside), and we do not knowingly collect personal information from children. If you believe that a child has provided us with personal information, please contact us so that we can take appropriate steps.

(4) Cross-Border Data Transfers

Your personal information may be stored or processed in countries other than your own.
In such cases, we use reasonable contractual, technical, and organizational safeguards to protect your personal information in accordance with applicable privacy laws.

3. Information We Collect, How We Collect It, and How We Use It

Depending on how you interact with the Services, the following data is collected by or on behalf of Navimow that may constitute Personal Information:

3.1 Data You Create or Provide to Us

We collect certain information you choose to create or provide to us when you visit or use the Services, including:

When you create a Navimow account, you must provide data including email address and/or mobile number, and a password. We may process your username and password (whether alone or in combination with other data) to detect fraud, to enable you to log into our APP or Services, and to appropriately control your access to restricted content. We process this Personal Information as necessary to provide you with our Services, as well as to further our legitimate interests of protecting our Services and the content on our Services.

User Profile Data

You have choices about the information on your profile. You may choose to edit your username and nickname, or can choose to include an image to represent yourself. You don’t have to provide additional information on your profile; however, profile information helps you get more from our Services, including making connections with other users of our products. We do not require Users to include sensitive data (e.g., race, ethnicity, political opinions, religious or philosophical beliefs, trade union membership, physical or mental health, sexual orientation or criminal record) in their User profile. If you choose to post any such data in your bio, it is visible to others like the rest of the profile information you provide. Please do not post or add Personal Information to your profile that you would not want to be publicly available.

 

3.2 Data Created During Use of Our Services

We may also collect certain information automatically as you use our Services, by means of various software tools. We use such information to assist in log-in, systems administration, and information security and abuse prevention purposes, as well as to track user trends, understand the usage of our Services, analyze the effectiveness of our Services, and improve our Services. Some or all of the automatically collected information may, alone or in combination with other information, constitute Personal Information under certain laws pertaining to data privacy and we manage such information in accordance with this Privacy Notice. Robot Type

We collect information about the robot or product model and serial number to fulfill your request for products and services.

Your Robot Data

You may authorize the APP to search a Segway Navimow robotic mower to control and monitor the operational and technical status of your Segway Navimow robot. We collect telemetry data regarding performance, usage, operation, and technical status of the robot to provide you with services, maintenance (including remote diagnostics and support), and improve the robot over time based on either your consent or our legitimate interests in ensuring the safety, security and improvement of our products and Services.

Location Data

We collect location data (e.g., GNSS, IP addresses, country codes) from a user’s mobile device if enabled by the user to do so. You may use the APP without enabling Navimow to collect location data from your mobile devices. However, this may affect some functionality available in the APP.

 

Our robots use location data to enable features such as anti-theft, virtual boundary, and robot navigation. Exact Fusion Locating System (EFLS) technology may use a combination of GNSS, gyroscope, accelerometer, magnetic compass, odometer sensors, Bluetooth, IP address, Wi-Fi and mobile towers to figure out where the robot is located. To protect your privacy, location data is either processed directly without leaving the robot, or remains inaccessible to us unless required for response to technical issues for diagnostic purposes.

Environmental Data

Our robots are equipped with smart technology to collect information about the space in which the robots are deployed. For example, the robot may collect information about the working areas and off-limit areas, satellite signal strength, existence of certain types of objects and obstacles (either detected by a bumper, ultrasonic sensor or vision sensor). We use this information to provide certain features and functionalities, diagnose and fix technology problems, iterate our algorithm and tailor our service to work more effectively.  

 

Some robot models or accessories are equipped with vision sensors to provide advanced features such as smart object detection and avoidance. To recognize objects like lawn grass, data from the vision sensor is processed directly without leaving the robot by default. We may collect data when there is an occurrence of a faulty event (such as obstacle collision, or STOP button pressed). Those data are used to learn how to recognize things better. To protect your privacy, you may enable or disable the collection of this data at any time in the APP. If enabled, this data remains anonymous and is stored in a form that does not link to your account or serial number of the robot.

Diagnostic Data

We may maintain certain log files relating to the access and use of our APP and our robots. The information inside the log files may include internet protocol (“IP”) addresses, network request information, standard system logs, crash information and other identifier technologies (collectively, “Log Data”). Log Data may be used to monitor and analyze the use of the APP and robot, resolve technical issues, perform technical administration, enhance functionality and user-friendliness, and better tailor our Services to your needs.

Other Data Collected From Cookies, Web Beacons and Other Similar Technologies

We use cookies, which are small pieces of data stored in text files, to make interactions with our Services easy, efficient, and meaningful. When you visit our Services, our servers may send a cookie to your computer or other device. Cookies collect and allow us to compile information about the usage of our Services and interaction with emails from us.  If you identify yourself to us, then these cookies may also collect Personal Information and may allow us to track your usage of our Services, determine your usage preferences, and improve and customize your experience when using our Services. We may use cookies that are session-based or persistent. Session cookies exist only during one session; that is, they are downloaded to your web browser when you visit our Services, but then disappear from your computer/device when you close your browser software or turn off your computer/device. Persistent cookies are used for multiple visits to our Services and remain on your computer/device after you close your browser or turn off your computer/device. We may use web beacons, either alone or in conjunction with cookies, to compile information about your usage of our Services and interaction with communications from us. Web beacons, also known as pixels, are clear electronic images that can recognize certain types of information on your computer/device, such as cookies, when you view a particular site or email tied to the web beacon. For example, we may place web beacons in marketing emails that notify us when you open an email or click on a link in the email that directs you to our Services. We may also use web beacons to operate and improve our Services and email communications. Unlike cookies, however, web beacons are not stored on your computer/device, so even if you disable cookies on your web browser, web beacons may still load and be used as described above.

 

Some third parties may also use cookies or other methods to gather information regarding your use of our Services. These third parties may use these cookies or other tracking methods for their own purposes by evaluating information about your use of our Service in combination with any Personal Information about you that they may have. The use of this information, including any Personal Information they may have about you, by these third parties is subject to the privacy notices or privacy policies of such third parties, if any, rather than this Privacy Notice.

3.3 Data from Other Sources

Navimow may collect data about you from other sources, such as insurance providers, publicly available sources, and marketing service providers. Navimow may combine the data collected from these sources with other data in its possession and when applicable, any such Personal Information is subject to this Privacy Notice.  

 

4. Additional Purposes for Which We Use Your Personal Information

In addition to some of the specific uses of information we describe in Section 3 above, we may use your Personal Information we receive to:

· provide, develop and enhance our Services and help you efficiently access your account and information after you sign in;

· remember information so you will not have to re-enter it during your visit or the next time you visit the APP or use the Services;

· provide and administer the Services, information, content, and products you requested;

· to contact you in connection with our APP and Services and in connection with certain other services (including new features, functionality, or services), notifications, programs or offerings that you may have registered for, or otherwise communicate with you;

· develop analytics, perform business analyses, or perform similar tasks to improve the quality of our business, our Services and the content and products we offer;

· diagnose or fix technology problems;

· automatically update the Navimow APP on your device;

· create aggregated, non-personal information, and/or de-identified information;

· comply with our legal obligations and protect our rights, our property, and the rights of third parties;

· ensure the technical functionality and security of our Services and prevent fraud; or

· other purposes when you consent to certain collection, use and disclosure of your information.

 

5. When We Share Your Personal Information

The following sets forth when and to whom we disclose Personal Information collected through our Services.

We will share your Personal Information within our affiliated companies to provide and develop our Services. We may combine information internally across the different Services covered by this Privacy Notice to help our Services be more relevant and useful to you and others.

For example, we may share your Personal Information with service providers who assist us in performing core functions (such as hosting, data storage, and security) related to the operation of our Services and/or by making certain interactive tools available to you as a user of our Services. We may also use service providers for technical and customer support, application development, data analysis (quantitative and qualitative), tracking and reporting functions, quality assurance, and other services. We may share Personal Information from or about you so that we can deliver our Services effectively. We may share your Personal Information with our auditors, lawyers or other professional advisors so they can support our business. Service providers are bound by obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

Purchasers of Our Business

We may transfer or assign this Privacy Notice and any Personal Information to a related or third-party entity as part of a merger, acquisition, sale, or other change of control of our business, assets, or equity, including in connection with any bankruptcy or similar proceedings.

Law Enforcement, Data Protection Authorities, or Other Third Parties

We may disclose Personal Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our Terms of Use or legal rights, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Navimow, our users, or the public.

 

We also may share anonymized information and statistics in aggregate form with third parties for business purposes. For example, we may share trends about the general use of our Services, such as the number of customers in certain demographic groups who purchased certain products or who carried out certain transactions.

 

6. Your Choices

6.1 Cookies and Online Tracking

When you use our Services, we may use cookies and related online tracking technologies to collect and store information about your access and use of the Services, as further noted in Section 3.2 above. You can adjust the settings on your mobile device or browser to limit what information is tracked through your use of the Services. Please note that disabling certain tracking may impact your ability to use certain functionality of the Services.

 

Our APP and Site do not currently respond to browser-based Do-Not-Track signals.  For information regarding Do-Not-Track and how to enable this setting if available on your devices, please see https://allaboutdnt.com.

 

6.2 Updating Your Account

You may be able to make changes to your account and download data about you collected through our Services via the account management tools available on our APPIf you need assistance with this, you may submit a support request to privacy@rlm.segway.com and we will use commercially reasonable efforts to respond in a timely mannerPlease note, however, that the only way to make some requested changes to your account may be by you through the APP, following your successful loginYou may close your account via the account management tools in the APP.

 

6.3 Direct Marketing

We may use your email address or account to provide marketing materials to you relating to our goods and Services or those of other Navimow family of companies, in accordance with applicable laws. You have the right to opt out of our use of your Personal Information for direct marketing. If you no longer wish to receive certain types of email communications you can opt-out by sending an email to privacy@ninebot.com or by using the unsubscribe link in our communications.

 

6.4 Control Data Collection from a Mobile Device

6.4.1 Device Settings. All major mobile device operating systems enable the users of mobile devices to control the types of data collected in and through mobile applications.

6.4.2 Data Collected Via Bluetooth. All major mobile device operating systems enable the users of mobile devices to disable Bluetooth from functioning.

· iOS. You can disable Bluetooth by going to “Settings” from your device’s home screen; select “Bluetooth”; and turn Bluetooth off.

· Android. You can disable Bluetooth by going to the Settings app, then “Wireless and networks,” where you can disable Bluetooth.

 

7. Transfer of Personal Information Outside of Your Jurisdiction

To the extent that we may need to transfer Personal Information outside of your jurisdiction, whether to our affiliated companies or service providers, we shall do so in accordance with applicable laws. In particular, we will implement appropriate safeguards to protect the transfer of information. You will have the right to be informed of the appropriate safeguards taken by Navimow for this transfer of your Personal Information.

Navimow may use overseas facilities operated and controlled by Navimow to process or back up your Personal Information. Currently, Navimow has servers in China, United States, Singapore and Germany.The laws in these overseas jurisdictions may be less protective than the region in which you are located. However, this does not change any of our commitments to safeguard your Personal Information in accordance with this Privacy Notice.

 

8. Retention of Personal Information

We reserve the right to retain any Personal Information as long as the Personal Information is needed to: (a) fulfill the purposes that are described in this Privacy Notice and (b) comply with applicable law.

 

9. Data Security

We implement appropriate technical and organizational measures to help protect the security of your Personal Information. We follow generally accepted industry standards to protect the Personal Information submitted to us. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee the absolute security of Personal Information, our APP or our Services.

 

10. Children’s Privacy

Our Services are not intended for children under age 18 and we do not target children or knowingly collect any Personal Information directly from children under the age of 18. If we learn that we have collected any Personal Information of a child under the age of 18 years, we will take reasonable steps to delete the Personal Information. This may require us to delete the Navimow account for that child. If you believe that we might have any information from or about a child under 18, please email us at legal@navimow.com.

 

11. Changes to This Privacy Notice

Our Services may change and evolve over time. We may update this Privacy Notice from time to time in our discretion to reflect changes to our information practices. If we make material changes to this Privacy Notice, we will notify you in accordance with applicable law and will post the revised version on the Services with the last updated date reflecting the effective date of those changes. We may also provide the revised Privacy Notice to you by: (i) showing it to you again when you access the APP, or (ii) via inclusion in our next APP update that is submitted to the Apple and Google mobile application platforms, (iii) sending an email notifying you of the changes to the email address we have on file for you, or (iv) include a notice on our Services. 

We encourage you to periodically review this page for the latest information on our privacy practices. The “Last Updated” legend at the top of this page will be updated with each change to this Privacy Notice. Your continued use of the APP and Services after this Privacy Notice has been updated indicates your agreement and acceptance of the updated version of the Privacy Notice. If the updated Privacy Notice is not acceptable to you, your sole recourse is to stop using and accessing the Services. Unless otherwise indicated, any changes to this Privacy Notice will apply immediately upon posting to the Services.

 

12. Third Party Websites and APPs

Our Services may contain links to third-party websites and services that are not owned or controlled by Navimow (collectively, “Third Party Websites”). We do not endorse any such Third Party Websites or the information, materials, products or services contained on or accessible through such Third Party Websites. We have no control over, no obligation to monitor and are not responsible for the privacy practices or the content of any Third Party Websites, and you visit them at your own risk and understand that this Privacy Notice does not apply to your use of any such Third Party Website. Accordingly, you expressly relieve us from any and all liability arising from your use of any Third Party Website. We encourage you to read the terms and conditions and privacy policy or privacy notice of any Third Party Website that you visit.

In order to provide you with a better product and Service experience, our APP will embed software development kits (SDKs) of authorized partners. We conduct security monitoring on the SDKd used by our partners to obtain information to protect data security. The third-party SDK we access mainly serves the needs of you and other users. Therefore, we may adjust the third-party SDK we access when meeting new Service requirements and business function changes. This Canada Privacy Notice applies to residents of Canadian provinces, including Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island, Quebec, Saskatchewan, Yukon, Nunavut, etc. This Canada Privacy Notice supplements the information contained in the Navimow Privacy Notice and applies solely to  residents of the provinces with applicable data privacy laws listed above. Unless otherwise defined in this Canada Privacy Notice, all terms defined in the Navimow Privacy Notice and all other terms defined in the applicable Canada provincial privacy law retain the same meaning when used in this Canada Privacy Notice.

Information We Collect

We sell personal information and share it for cross-contextual behavioral advertising purposes, which means we display advertisements to you based on information we obtain about you through nonaffiliated websites, applications or online services to predict your interests or preferences. Sources of Personal Information

As described in Section 3 “Information We Collect, How We Collect It, and How We Use It” above, we have collected personal information directly from you when you provide it to us (such as when you register your account on the Services); automatically based on your interactions with the Services; and from the categories of third parties listed in that section and by combining personal information we may otherwise obtain.

 

Purposes for Collecting Personal Information

Section 3 “Information We Collect, How We Collect It, and How We Use It”, Section 4 “Additional Purposes for Which We Use Your Personal Information”, and Section 5 “When We Share Your Personal Information” of the Privacy Notice describe how we collect, use, or disclose personal information for business and commercial purposes.

 

Retention of Personal Information

The period for which we retain your personal information varies, depending on the type of personal information and the purpose for which it was collected. The duration is limited to time necessary to fulfill the purposes for which the information was collected, in light of any restrictions or deletions you might request, as well as our need to address our legal obligations or rights.

 

Your Privacy Rights

You can exercise your rights of access and rectification as described in Navimow Privacy Policy or by contacting our Privacy Officer by using the contact information provided.

We design our products and services with privacy in mind. With many types of data, we’ve provided you with the ability to simply delete it if you don’t want us to process it anymore. For other types of data, we’ve given you the ability to stop the use of your data by disabling the feature altogether. You may be able to exercise the following rights in relation to the personal information about you that we have collected (subject to certain limitations and exceptions at law), see list below.

Right of Access/ Right to Know

The right to request the following information relating to the personal information we have collected about you and disclosed about you:

· The categories of personal information we have collected about you;

· The existence, use, and disclosure of your personal information

· The categories of sources from which the personal information was collected;

· The ways in which your personal information has been collected, used, and shared.

· The business or commercial purposes for collecting, selling, or sharing the personal information;

· The categories of third parties with whom the business shares personal information;

· The categories of personal information sold, and for each category identified, the categories of third parties to whom it sold that particular category of personal information; and

· The categories of personal information that the business disclosed for a business purpose, and for each category identified, the categories of third parties to whom it disclosed that particular category of personal information.

We will respond to access requests within the time period required by applicable law, subject to limited statutory exceptions.

 

Right to Access (Right to Know Specific Pieces of Information) / Portability

The right to access and obtain a copy of the specific pieces of personal information we have collected about you, provided in a structured, machine-readable format that may be transmitted to another entity without hindrance, to the extent technically feasible. 

Right to Correction

You have the right to request correction of inaccurate, incomplete, or outdated personal information we maintain about you. Where appropriate, corrected information will be communicated to third parties who have access to the inaccurate information.

 

Right to Request Deletion Under Certain Circumstances

You may request that we delete or anonymize your personal information where:

· The information is no longer necessary for the purposes for which it was collected; and

· Retention is not required by law, regulation, or legitimate business needs.

This right is subject to statutory retention and compliance obligations.

 

Right to Opt Out of Data Sales or Sharing

The right to direct us not to sell or share personal information we have collected about you to third parties, including for ad targeting/cross contextual advertising.

Right to withdraw consent

Where we rely on your consent to collect, use, or disclose your personal information, you may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. Please note that withdrawing consent may affect our ability to provide certain services.

How to Exercise Your Privacy Rights

To Exercise Your Rights to Know, Access/Data Portability, Correct, Delete,

Submit a verifiable consumer request to us by emailing us at legal@navimow.com

We may need to verify your identity and confirm you are a resident of a province that offers the requested right(s) before processing most requests, which may require us to obtain additional personal information from you. To verify your identity, we will generally require either the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your name, email address and mailing address in the original request, as well as an explanation of the rights you wish to exercise. We will only use the personal information provided in connection with a Privacy Rights request to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.

 

If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. Please see the “Authorized Agents” section below for more information.

 

In certain circumstances, we may decline a request to exercise the rights described above, in accordance with applicable law.

 

To Exercise Your Right to Opt Out of Personal Information Sales or Sharing

You do not need to create an account with us to exercise your Right to Opt Out of Personal Information Sales or Sharing. However, we may ask you to provide additional personal information (including your name, email address and mailing address) so that we can properly identify you in our dataset to facilitate the opt-out request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

Personal Information of Children Under Age 16

We do not sell or share personal information of consumers we know to be less than 16 years of age (depending on your province of residency), unless we receive affirmative opt-in consent from the child who is between 13 and 16 years of age, or the parent or guardian of a child less than 13 years of age. The parent or the child who has opted into personal information sales or sharing may opt out of future sales at any time. Depending on your province of residency of residency, we do not process the personal information of minors under 18 years of age for the purposes of targeted advertising. We do not sell the personal information of minors under 18 years of age.

 

Authorized Agents

In certain circumstances, you are permitted to use an “authorized agent” to submit Privacy Rights requests on your behalf. We may verify the authorized agent’s authority to act on your behalf as follows: 

 

For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Canada Notice, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

 

Financial Incentives

From time to time, we may offer you certain financial incentives permitted by law (such as offers, coupons, samples, loyalty programs and sweepstakes or contest rewards) in exchange for the collection, retention, use or share, or sale of certain personal information about you. Each financial incentive related to the collection and use of personal information is based upon our reasonable, good-faith determination of the estimated value of such information to our business. When necessary, we will provide information about the specific terms of the financial incentive, such as the type of personal information required to be disclosed, retained or sold in exchange for the benefit you may receive, and instructions on how to opt in or opt out, on the webpage or form where the financial incentive is made available.

 

Non-Discrimination

We do not discriminate against you for requesting any of the rights noted above. We are permitted to deny or limit your request in accordance with applicable laws.

This Privacy Policy has been provided in English and French to facilitate understanding for a broader audience. We have made every effort to ensure the accuracy and consistency of all versions.
